Terms of Service

These Terms of Service ("Terms") govern your use of the Rekindly platform ("Service"), operated by an individual founder based in France. By creating an account or using the Service, you agree to these Terms.
1. Acceptance of Terms
By accessing or using Rekindly, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Description of Service
Rekindly is a SaaS platform that connects to Shopify stores via Shopify OAuth to provide automated, AI-generated email and SMS sequences for abandoned cart recovery, first-order follow-ups, and customer lifecycle messaging. The Service processes customer data on behalf of merchants to generate and send personalised messages. Webhooks are registered automatically upon installation — no manual configuration is required.
The Service includes the following features (availability depends on your plan):
- Abandoned Cart Recovery — a 3-touch sequence of AI-written emails and SMS sent to customers who leave items in their cart
- FirstTimer — an automated thank-you email and follow-up SMS sequence triggered by a customer's first order
- Win-Back — an AI-written re-engagement email sent to customers who have not purchased within a merchant-configured number of days
- ReplyPulse — a sentiment-based post-purchase follow-up sequence triggered a configurable number of days after order delivery. ReplyPulse uses the Anthropic Claude API to analyse a customer's purchase history (order count, values, and frequency) and infer a sentiment classification (happy, neutral, or unhappy). This classification is based entirely on observed purchase behaviour — not on any feedback provided by the customer. Happy customers receive an AI-written review and referral request; neutral customers receive an AI-written message with an optional discount; unhappy customers are flagged on the merchant dashboard and are never contacted.
3. Merchant Responsibilities
As a merchant using Rekindly, you agree to:
- Disable Shopify's native abandoned cart emails to avoid duplicate messages to your customers. Rekindly replaces this functionality with its own sequences.
- Ensure the accuracy of your store information. Rekindly webhooks are registered automatically during installation via OAuth and do not require manual configuration.
- You may revoke Rekindly's access to your store at any time by uninstalling the app from your Shopify admin under Apps.
- Obtain all required consents from your customers before sending them automated marketing emails and SMS. This obligation applies to all Rekindly features, including Win-Back and ReplyPulse. You are solely responsible for compliance with applicable laws in your jurisdiction, including but not limited to GDPR, CAN-SPAM, CASL, and any local e-marketing regulations.
- Not use the Service to send spam, misleading content, or messages that violate any applicable law.
- Acknowledge that all emails and SMS messages generated by Rekindly — including Win-Back and ReplyPulse messages — are produced by AI. While Rekindly makes reasonable efforts to generate appropriate content, you are responsible for reviewing AI-generated messages where possible and for any content sent to your customers through the Service.
4. Payment and Billing
Rekindly offers a 21-day free trial. No credit card is required to start the trial. After the trial period, a paid subscription is required to continue using the Service.
Shopify merchants are billed directly through the Shopify Billing API. Subscriptions are managed entirely within your Shopify admin. For merchants on non-Shopify platforms (future), billing is handled via Stripe.
Cancellation: You may cancel your subscription at any time from your account dashboard or by contacting us. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
5. Prohibited Uses
You may not use Rekindly to:
- Send unsolicited or spam messages
- Transmit malicious code or attempt to compromise the Service
- Resell, sublicense, or redistribute the Service without written consent
- Use the Service in any way that violates applicable laws or regulations
- Misrepresent your identity or store information
6. Limitation of Liability
Rekindly is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or revenue, arising from your use of the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid to Rekindly in the 12 months preceding the claim.
7. Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. You may also terminate your account at any time by cancelling your subscription and contacting us to request account deletion.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of France.
9. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
